В настоящей статье рассматриваются предусмотренные ст. 45 ГПК РФ формы процессуального участия прокурора в гражданском судопроизводстве России. Отмечается, что законодатель не даёт легального толкования термину «неопределённый круг лиц», что на практике оборачивается правовой неопределённостью и формированием противоречивых судебных подходов. Отдельно рассматривается проблемный аспект: положение ч. 3 ст. 45 ГПК РФ, допускающее рассмотрение дела в отсутствие надлежащим образом извещённого прокурора. В заключение предлагаются рекомендации по совершенствованию действующего законодательства.

This article examines the forms of procedural participation of the prosecutor in civil proceedings in Russia as provided for by Article 45 of the Code of Civil Procedure of the Russian Federation. It is noted that the legislator does not provide a legal interpretation of the term «indefinite circle of persons,» which in practice results in legal uncertainty and the development of contradictory judicial approaches. We will examine a problematic aspect: the provision of Part 3 of Article 45 of the Code of Civil Procedure of the Russian Federation, which allows for case supervision in the absence of a duly notified prosecutor. The article concludes with recommendations for improving current legislation.
