Конституция Российской Федерации впервые ограничила роль государства в установлении прав человека и гражданина, но значительно повысила значимость и ответственность государства в обеспечении соблюдения и защиты этих прав и свобод. Конституция, учитывая теоретические основы естественно-правовой доктрины прав человека, исходит из того, что государство не предоставляет людям их основополагающие права и свободы: они принадлежат людям от рождения и неотчуждаемы (ч. 2 ст. 17 Конституции РФ). В статье автор делает вывод о том, что в специальной литературе различается защита и охрана субъективно го права или охраняемого законом интереса. Охраняются права и свободы перманентно, а защищаются только тогда, когда нарушаются.

The Constitution of the Russian Federation for the first time limited the role of the state in establishing human and civil rights, but significantly increased the importance and responsibility of the state in ensuring the observance and protection of these rights and freedoms. The Constitution, taking into account the theoretical foundations of the natural legal doctrine of human rights, proceeds from the fact that the state does not provide people with their fundamental rights and freedoms: they belong to people from birth and are inalienable (part 2 of article 17 of the Constitution of the Russian Federation). In the article, the author concludes that in special literature the protection and protection of subjective law or legally protected interest differs. Rights and freedoms are protected permanently, and protected only when violated.
